FAQ on Brexit and the online registration form of the Berlin Foreigners Registration Office

General questions about the target group

  • All British citizens and their family members already living in Berlin can register with us online to apply for a residency permit. If you have been staying or wish to stay in Berlin for longer than three months, please use this opportunity to register by 29.03.2019. This will ensure that the residency rights you have acquired in Germany will remain valid after Brexit, up to the point at which a decision is taken on your application.
  • If you don’t live in Berlin, please contact your local Foreigners Registration Office for more information.

  • If, in addition to British citizenship, you have German citizenship or you are a national of another EU member state or Iceland, Liechtenstein or Norway, then you do not need to register on our homepage. You will retain your right to freedom of movement.
  • If you have British citizenship and you are also a national of a third country 1, then we recommend that you register. We will invite you to to attend an advisory session in April or a subsequent month, where we will consider your ongoing entitlement to residency. The same applies to your family members if they only have the citizenship of a third country 1.

  • It remains unclear what the conditions of the United Kingdom’s departure from the European Union will be.
  • However, to secure your residency rights we strongly recommend that you make use of the possibility to register with us online before 29.03.2019.
  • This will save you a long wait for an appointment at our office, since from April 2019 onwards we will be contacting everyone who has registered to give them an appointment.

  • Your Residents Office registration only records you as a resident of Berlin. The confirmation of registration you received then enables you to prove that Berlin is your place of residence.
  • However, this document says nothing about your legal status in Germany under residency law. We therefore recommend that you apply online for a residency title using the form provided on our homepage.
  • The confirmation of your registration with the Foreigners Registration Office which you will receive (and can print out) after entering your data serves to document your lawful residency in Germany.

  • The Berlin Foreigners Registration Office is already using various communication channels including our own website and press releases to draw attention to the online registration scheme. We are grateful for your support in order to reach all Britons in Berlin.
  • If you know of someone who is unable to complete the registration form, do please support them by helping them to complete it or by passing their contact details to us. Please use our contact form. In the latter case we would be happy to make contact with that person ourselves.

Residence in Berlin?

  • This form is only designed for British citizens and their family members who already live in Berlin.
  • If you do not live in Berlin, please get in touch with the local Foreigners Registration Office in your place of residence.

  • If you have several places of residence in Germany, the Foreigners Registration Office where you have your primary place of residence will be responsible.
  • Please do not complete our registration form if you are only registered as having your secondary place of residence in Berlin. In that case you should get in touch with the Foreigners Registration Office in your primary place of residence.

  • You should not complete our registration form if you are not registered as resident in Germany, but merely commute here from another EU country or a third country for reasons of work. In that case please make enquiries with the relevant authority in your place of residence.
  • Please note that, after the United Kingdom’s departure from the EU, as things currently stand you would only be able to enter Germany without a visa as a tourist.

Questions on completing the form

  • Please do not re-register via the form on our homepage!
  • The Berlin Foreigners Registration Office will correct your entry. Please use our contact form

  • With regard to families living together in a flat or house, please ensure that only one adult member of the family completes the form. The spouse and/or children under 18 should then be entered in the relevant field on the form. The citizenship of these family members is immaterial (unless they are German). Please enter the full names of all family members who live together with you in a single household.
  • Family members who are registered with their own household in Berlin, rather than with you, should ensure that they complete the registration form separately. This also applies to adult children who live together with their parents in a shared apartment.

  • For this purpose family members are only spouses, registered same-sex civil partners and children under 18.
  • If you live in a household together with someone in a (non-marital) partnership, then both of you must complete the registration form separately.

  • No problem. Please enter the information for each family member in the designated field, providing information about each member’s citizenship.
  • The only exception here is German family members, for whom you do not need to provide personal details. For such cases the registration form just asks you to state whether you have any German family members, to which you must simply answer “yes“ or “no“.

  • You meet the threshold for five years of residency if, by 29.03.2019, you will have had your place of residence in Germany for at least five years.
  • Temporary interruptions of less than six months in a calendar year, or longer periods of absence for important reasons (e.g. pregnancy, serious illness, studies), make no difference.
  • If the United Kingdom were to leave the EU at a later date, the cut-off date would be extended accordingly. Currently the Berlin Foreigners Registration Office is working on the assumption that the UK will leave on 29.03.2019.
  • If you are unsure, please state your assumed length of residency. We will examine your circumstances individually at your personal appointment.
  • Nonetheless, we kindly request that your response is as accurate as possible, to enable us to advise you as swiftly and thoroughly as possible.

  • You can inform us of any subsequent changes to your status such as through marriage or the birth of a child by using this contact form. We will then update your entry.

  • If you move within Berlin, please let us know your new address by using this contact form. The Belin Foreigners Registration Office will then update your entry.
  • If you move out of Berlin to somewhere else in Germany or even leave the country, we would also ask you to let us know using the contact form. We will then delete the entry with your personal data from our records. Please then get in touch with the local Foreigners Registration Office in your new place of residence.

Confirmation of registration

  • You won’t receive separate confirmation (e.g. in the form of an email) of your registration with the Berlin Foreigners Registration Office.
  • After sending the completed online form your screen will display a summary of your entry and a confirmation of your registration.
  • We strongly recommend that you print out this page and save a copy.
  • If you didn’t print out and save a copy of the confirmation, you can use our contact form to request one, and we will then send you another confirmation.

  • The confirmation serves as proof of your application and your lawful residence in Germany.
  • Should you encounter any difficulties with your employer/landlord/ other public authorities, please refer them to the latest information on our homepage.

  • The confirmation document remains valid until your application has been concluded, provided that you also attend the appointment we at the Berlin Foreigners Office give you in April 2019 or later.
  • If you are unable to make the appointment and let us know in good time in advance, then the validity of your registration confirmation will be unaffected. In that case you will simply attend the alternative appointment we give you.

  • The confirmation you received was issued by the Berlin Foreigners Registration Office. Since Germany is a federal country and each Foreigners Registration Office can design their own procedures for the registration of British nationals, there will be discrepancies between the procedures and confirmation documents across the country.
  • Please don’t be unsettled or concerned by this. By registering on our homepage your continued residency is lawful across the whole of Germany.

Next steps in the process

  • From April 2019 onwards we will be contacting by post or email everyone who registered using the online form to offer an appointment.
  • The notification of an appointment will set out which documents you will need to bring with you.
  • Until such time we would ask for your patience.

  • The online appointments booking service at the Berlin Foreigners Registration Office will be unavailable for British citizens for the time being.
  • Appointments that have been booked under false nationality will be deleted immediately.
  • Please use the online registration process on our homepage. To help you avoid unnecessarily long waiting times, we will invite you to a set appointment in April or a subsequent month.
  • We are grateful for your understanding and would ask for your patience until such time as you have an appointment.

Questions about residency law

Neither you nor your family members will have to first leave Germany to go through any prospective visa procedure, provided that you and your family members are registered as resident in Berlin and that you have also registered on the homepage of the Berlin Foreigners Registration Office by 29.03.2019.

  • The confirmation displayed on your screen after you have completed and sent the online form serves as proof of your registration and lawful residence in Germany, including the entitlement to work. Your employer does not need any further permit in order to employ you.
  • Should you encounter any difficulties with your employer/landlord/ other public authorities, please refer them to the latest information on our homepage.

  • By registering on the homepage of the Berlin Foreigners Registration Office you have submitted an application for a residency permit.
  • At your personal appointment we will consider which residency title is an option for you. We ask for your understanding that it will not be possible, in advance, to provide information on every single purpose of residency and for all eventualities.
  • The Berlin Foreigners Registration Office will seek to advise you individually and as swiftly and thoroughly as possible. However, this will not be possible until April and the subsequent months. At the given time we will invite you to attend an appointment. Until then we ask for your patience.
  • Until this time the confirmation of your completed online registration form serves as proof of your application and your lawful residence in Germany.
  • With this confirmation you can continue to enjoy all the rights you exercised as an EU citizen entitled to freedom of movement, e.g. engaging in economic activity.

  • Until the time of your appointment with the Berlin Foreigners Registration Office (in April or a subsequent month), the confirmation of your completed online registration form serves as proof of your application and your lawful residence in Germany. With this confirmation you can continue to enjoy all the rights you exercised as an EU citizen entitled to freedom of movement, e.g. engaging in economic activity and drawing welfare benefits under SGB II/XII.
  • Should you encounter any difficulties with your employer/landlord/ other public authorities, please refer them to the latest information on our homepage.

  • No, the confirmation does not entitle you to travel to other European states or third countries or to re-enter Germany. If you need to travel, please consult the website of the Federal Interior Ministry for information about valid transitional provisions.
  • If you intend to leave Germany for a longer period of time, please consult the nearest German embassy in your future place of residency about the entry provisions applying after Brexit.

British passports

  • No, although please do ensure that you apply to the British authorities for a new passport in time.
  • The confirmation of your successful registration issued by the Berlin Foreigners Registration Office states merely the requirement to hold a valid passport. You are not requested to provide the number of your passport as part of the online registration process, and so this number of course does not feature on the confirmation. Provided you are in possession of a valid passport, you will not encounter any difficulties.

  • Please do not complete the form if your passport says “British National (Overseas) / British Overseas Citizen / British Overseas Territories Citizen / British Subject / British Protected Person” rather than “British Citizen”. The possibility to register on our homepage is only designed for British citizens who are in possession of a passport with the designation “British Citizen” and who are entitled to exercise the right to freedom of movement.
  • If your passport contains one of the above-mentioned designations and you wish to apply for a residency title or an extension of a residency permit in Berlin, please book an appointment with Section E 5 of the Berlin Foreigners registration Office. If you are re-entering Germany, please note the requirements when applying for a residency permit here, particularly the rules on entry and visas.

Questions about the naturalisation process

As long as you do not possess German citizenship, you should register online with the Berlin Foreigners Registration Office, even if you have submitted an application for German citizenship. This is the only way to ensure that your residency in Germany remains lawful.
