Brexit - Update vom 01.02.2020

Das Austrittsabkommen ist sowohl von Großbritannien als auch der EU ratifiziert worden. Somit ist es am 31.01.2020 zu einem geregelten Austritt des Vereinigten Königreiches aus der Europäischen Union gekommen.

• Durch den nun geregelten Austritt werden britische Staatsangehörige und deren Familienangehörige bis zum Ablauf der im Austrittsabkommen vorgesehenen Übergangsphase (aktuell bis zum 31.12.2020) aufenthaltsrechtlich weiterhin so behandelt, als wäre Großbritannien nach wie vor ein Mitgliedstaat der Europäischen Union.

• Sie behalten somit weiterhin alle Ihre bisherigen Freizügigkeitsrechte, z.B. Ausübung einer uneingeschränkten Erwerbstätigkeit, Bezug von Kindergeld, Beantragung eines Wohnberechtigungsscheines (WBS) etc.

• Britischen Staatsangehörigen, die bereits in Deutschland leben oder Ihren Wohnsitz innerhalb der Übergangsphase (bis 31.12.2020) nach Deutschland verlegen, soll ein Dokument zum Nachweis ihres Aufenthaltsrechts ausgestellt werden. Dies gilt auch für Familienangehörige, die nicht die britische Staatsangehörigkeit besitzen. Noch ist unklar, in welcher Form diese Dokumente auszustellen sind. Ebenfalls steht noch nicht fest, ob und in welcher Höhe dafür Gebühren erhoben werden müssen. Hierzu erwarten wir noch weitere Informationen des Bundesministeriums für Inneres (BMI).

Vor diesem Hintergrund möchten wir auf Folgendes hinweisen:

• Bis auf weiteres wird das Landesamt für Einwanderung leider keine Einladungen mehr an britische Staatsangehörige verschicken können, die sich über unser Online-Formular registriert haben.
• Unabhängig davon bitten wir alle Registrierten, die bereits eine Einladung von uns erhalten haben, zu ihrem Termin zu erscheinen.
• In Berlin wohnhaften britischen Staatsangehörigen, die sich noch nicht online bei uns registriert haben, empfehlen wir auch weiterhin dies zu tun, unabhängig von dem nun vollzogenen Austritt des Vereinigten Königreiches.
• Sobald uns neue Informationen des BMI zum weiteren Vorgehen vorliegen, werden wir unmittelbar auf unserer Homepage darüber informieren. Wir halten Sie hier und in unserer speziellen Rubrik zum Thema Brexit auch weiterhin auf dem Laufenden und bitten Sie bis dahin weiterhin um Geduld.

The Withdrawal Agreement has been ratified both by the United Kingdom and the EU. The United Kingdom has thus left the European Union with a deal on 31.01.2020.

• Because the UK has left the EU under the terms of the Withdrawal Agreement, for the purposes of residency law British citizens and their family members will continue to be treated during the transitional phase (scheduled to last until 31.12.2020) as though the United Kingdom were still a member of the EU.
• You will therefore retain all your existing rights under free movement, for example the unlimited right to economic activity, the right to draw child benefit, and the right to apply for a public housing entitlement certificate (WBS).
• British citizens who are either already living in Germany or who transfer their place of residency to Germany during the transitional period (by 31.12.2020) are to be issued with a document to prove their right of residency. This arrangement also applies to family members who are not British citizens. It is not yet clear what form this document will take. Neither is it clear whether a charge will be levied to obtain one (and if so, the level of the charge). On this point we are awaiting clarification from the Federal Ministry of the Interior (BMI).

In this context we would like to make you aware of the following:

• Until further notice the Berlin Immigration Office will unfortunately be unable to issue any more invitations to British nationals who have registered using our online form.
• Nevertheless, we kindly request that any British nationals who have registered and already been given an appointment do attend this appointment.
• We recommend that all British nationals who are resident in Berlin register with us using our online form if they have not yet done so – irrespective of the fact that the UK has now left the EU.
• As soon as we receive any more information from the BMI on the next steps in the process, we will inform you on our website (our special section on the subject). We will continue to keep you up to date with the latest developments and kindly ask for your patience in the meantime.
