Senate grants right to remain in 186 cases of hardship

Application for a Residence Permit

The Berlin Senate is granting an extended right to remain to 186 individuals who were previously required to leave the country, on the basis of exceptional circumstances.

In numerous cases involving hardship related to disputes over the right of foreign nationals to leave or remain in the country, the Senate has, for the most part, granted permission for them to continue residing in Germany.

The Hardship Commission, which is called upon in certain areas, reported 367 cases involving 656 people, according to the commission’s latest annual report.

Each case was reviewed individually

More than 221 cases were reviewed. Senator for the Interior Iris Spranger (SPD) ruled on over 217 applications and granted a residence permit in 186 cases (86 percent) (2021: 77 percent, 2022: 96 percent, 2023: 91 percent, 2024: 90 percent). The six most common countries of origin for people in hardship cases were Turkey, Georgia, Azerbaijan, Armenia, Moldova and Serbia. Each of these cases is individually reviewed and examined by the Hardship Commission, officials said. The senator then makes a decision after considering the personal and humanitarian circumstances. "This has allowed us to offer many people in difficult life situations a reliable prospect of staying," Spranger stated.
