Tens of thousands of Berlin allotments on state-owned land are to be preserved permanently.
The Berlin Senate had already passed the corresponding Allotment Garden Area Protection Act in December 2025. On Thursday, the draft law was approved by a majority vote in the House of Representatives.
According to this, allotment gardens may only be rezoned, i.e. dismantled, within very narrow limits in future – for example, for the construction of affordable housing, schools, daycare centers, or hospitals. As a rule, the House of Representatives must approve such cases. According to the law, affected allotment gardeners must be offered replacement land of comparable size. The new law affects a good 56,000 allotment gardens on state-owned land, which together cover an area of 2,283 hectares. Allotment gardens on other land, such as that owned by Deutsche Bahn, are not covered by the regulation.
