Court confirms demonstrations ban on New Year's Eve
Demonstrations on New Year's Eve remain prohibited in Berlin.
The Administrative Court of Berlin has rejected a corresponding emergency application against the demonstration ban applicable under the current Infection Protection Ordinance of the Senate (Az.: VG 1 L 458/20). This was announced by the court on Wednesday (December 30, 2020) upon request. A press release announcing the reasons for the decision will follow.
Demonstrations and rallies not allowed on New Year's Eve and New Year's Day
In light of the Corona pandemic, the Senate has banned demonstrations and rallies on New Year's Eve and New Year's Day in Section 26 of its current Infection Protection Ordinance. An urgent appeal against this had been received by the Administrative Court. The applicant had himself registered a meeting for New Year's Eve.
"Querdenken" demonstration banned on December 30
However, this was not about the "Querdenken" demonstration against state restrictions in the Corona crisis, which had originally also been registered for New Year's Eve. The organizers had brought it forward to December 30 after the ban on the demonstration became known. The police subsequently banned the demonstration.
