Gambling equipment with winning opportunities - permit

You require permission from the competent authority, if you intend to set up gambling equipment with winning opportunities on a commercial basis.

Any device that is technically equipped with an independent mechanism that has decisive impact on the outcome of a game, is considered as gambling equipment with winning opportunities.
Players are not able to directly and actively influence the course of a game. Instead, gaming success is determined by a specially constructed, independent mechanism. It is irrelevant whether possible winnings are in the form of cash or of goods.

It is only permitted to set up gambling equipment with winning opportunities, whose design is approved by the National Metrology Institute.

Installation must only take place in locations whose suitability has been confirmed in writing by the municipality of the place of installation.

Gambling equipment must only be set up in public houses or restaurants that require licensing, in gambling halls or similar enterprises as well as betting agencies run by licensed bookmakers.

Gambling equipment with non-cash prizes may also be set up at public festivals, fairs and similar events, as well as at carnivals and special markets.

Prerequisites

  • Personal reliability
    Reliability is verified based on various documents. The applicant must submit an excerpt from the Federal Central Criminal Register (certificate of good conduct) and an excerpt from the Commercial Central Register.
  • Expertise
    Proof of sufficient training regarding gambling and youth protection
  • Social concept
    Concept from an officially recognised organisation that provides for measures to prevent socially damaging effects of gambling.

Documents required

  • Certificate of good conduct
    Certificate of good conduct from the German Federal Central Criminal Register for presentation to an authority (certificate type 0).
    The certificate must be applied for in the municipality of residence (in the case of Berlin at any Citizens’ Office) for presentation to an authority. This means that it will be sent directly to the competent Public Order Office for the place of business. The certificates must be no older than three months.
    They can also be applied for with the Federal Office of Justice.
  • Excerpt from the Commercial Central Register - natural entity
    Statement from the Commercial Central Register for natural entities, for presentation to an authority (certificate type 9).
    The certificate must be applied for in the municipality of residence (in the case of Berlin at any Citizens’ Office) for presentation to an authority.   • Up to date excerpt from the Trade Register
    Registered companies are required to submit an up to date excerpt from the Trade Register when applying. Legal entities that are in the process of being established (GmbH, AG) are required to submit their partnership agreement or statutes.
  • CCI proof of training
    Every operator must provide proof from a Chamber of Commerce and Industry that they have undergone sufficient training regarding gambling and youth protection and are therefore qualified for exercising such business activities.

    Furthermore, operators must only task such individuals with installing the gambling equipment that have also taken part in a training session. This obligation does not apply, for example, to the operator’s staff that performs office work only.
  • Social concept
    The applicant must provide evidence of a social concept by an officially recognised organisation, which provides for measures for preventing socially damaging effects of gambling.

    The social concept must illustrate in which ways the provider and their staff members are able to recognise problematic gambling behaviour at an early stage.

    The concept applies for the gambling equipment provider’s entire business, i. e. it includes the business owner and their employees. Such a concept must include provisions for training staff, information regarding counselling services and provision of opportunities for gamblers to assess their exposure to risk. The staff is included in the concept to ensure that not only the applicant but also their employees on site are trained regarding addictive behaviour and are thus able to recognise gamblers who are at risk and to take appropriate measures.

    Availability of suitable information material including information about counselling for addiction-prone gamblers must also be provided for by the concept.

    Officially recognised organisations that develop such concepts are in particular institutions for addiction related matters, support and addiction prevention.
